These Terms & Conditions (“Terms”) govern your access to and use of www.bodywrappers.com (the “Website”) and your purchase of products and services from AMPT Dance Company LLC, doing business as Body Wrappers (“Body Wrappers,” “Company,” “we,” “us,” or “our”).

By accessing the Website, creating an account, or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy, and Return & Refund Policy, each of which is incorporated into these Terms by reference.

The Website is intended for use by adults. Products intended for children should be purchased by a parent, guardian, or other authorized adult.

1. Eligibility and Use of the Website

You may use the Website only for lawful purposes and in accordance with these Terms.

By placing an order or creating an account, you represent that:

• You are legally able to enter into a binding transaction.
• The information you provide is accurate and complete.
• You are authorized to use the payment method submitted.
• Your purchase is for lawful purposes.

Consumers, studios, production companies, costume departments, schools, teams, and other organizations may purchase products through the Website.

2. Customer Accounts and Guest Checkout

You may be able to purchase products through a customer account or as a guest.

If you create an account, you are responsible for maintaining accurate account information and for activity occurring through your account. You should promptly notify us if you believe your account has been accessed or used without authorization.

Registered customers may be able to save addresses, order history, shopping cart information, and payment methods where such functionality is offered through Shopify or an applicable payment provider.

We may suspend or terminate an account, cancel an order, or restrict Website use where we reasonably believe there has been fraud, misuse, unauthorized activity, payment abuse, a violation of these Terms, or conduct harmful to Body Wrappers or other customers.

3. Products and Product Information

We make reasonable efforts to describe and display our products accurately. However:

• Colors may appear differently depending on device screens, lighting, photography, dye lots, materials, or manufacturing variations.
• Fabric texture, finish, shade, and minor product details may vary.
• Product availability is subject to change.
• Product images are provided for general illustration and may not perfectly represent the product received.

Any size chart or fit guidance provided on the Website is offered as a general reference only. Sizing and fit may vary by product, fabric, body type, intended use, and personal preference. Customers are responsible for selecting the products and sizes appropriate for their needs.

Customers should follow any care instructions provided with a product or displayed on the Website.

4. Orders and Acceptance

When you submit an order and receive an order confirmation, your order is accepted, subject to product availability, successful payment processing, and our limited right to cancel or refund an order as described below.

We may cancel or refund an order, in whole or in part, where reasonably necessary due to:

• Product unavailability or inventory errors.
• Incorrect product descriptions or pricing errors.
• Payment authorization failures.
• Suspected fraud or unauthorized payment activity.
• Website, system, or technical errors.
• Shipping restrictions.
• Misuse of discounts, promotional codes, or store credits, where applicable.
• Violation of these Terms.

If we cancel an order after payment has been processed, we will issue an applicable refund to the original payment method or restore any eligible store credit used for the purchase, as appropriate.

We do not currently offer preorders or backorders through the Website.

5. Prices, Taxes, and Payment

All prices displayed on the Website are in U.S. dollars unless expressly stated otherwise.

Prices do not include applicable sales tax, shipping charges, or other charges that may be calculated and displayed at checkout.

We may change prices, products, promotions, or availability at any time before an order is placed. Price changes will not affect orders already accepted, except where an order involves an obvious pricing, product-description, or technical error.

Payment methods may include:

• Credit or debit cards.
• PayPal.
• Shop Pay.
• Apple Pay.
• Google Pay.
• Body Wrappers store credits, where available.

Payments are processed through Shopify and/or applicable third-party payment providers. Where available, you may elect to save payment information through Shopify or an applicable payment provider for future purchases.

6. Promotions and Discount Codes

We may offer promotional codes, discounts, sales, free-shipping promotions, or similar offers from time to time.

Unless expressly stated otherwise:

• Promotions may be modified or discontinued at any time before an order is placed.
• Promotional codes may have expiration dates.
• Promotions may be limited to specified products, collections, customers, or order amounts.
• Minimum-purchase requirements may apply.
• Certain products may be excluded.
• Promotional codes may not be combined with other offers.
• Promotions have no cash value.
• Promotions may not be applied retroactively to prior purchases.
• We may reject or cancel promotional use that is unauthorized, fraudulent, abusive, or inconsistent with the applicable offer terms.

7. Store Credits

Body Wrappers may issue store credits in limited circumstances, such as promotional offers or customer service resolutions.

Any applicable expiration date, redemption conditions, product restrictions, or other limitations will be disclosed when the store credit is issued. Store credits may be used only for eligible purchases through the Website and are not redeemable for cash except where required by law.

Approved refunds for eligible returned products are generally issued to the original payment method used for the purchase.

8. Shipping and Delivery

Purchases made through the Website are subject to our separate Shipping Policy, which is incorporated into these Terms by reference.

We may provide estimated processing or transit times, such as standard shipping estimates. These estimates are not guaranteed delivery dates.

Shipping charges, available shipping methods, and applicable free-shipping promotions will be displayed at checkout where available.

Customers are responsible for providing a complete and accurate shipping address. Body Wrappers is not responsible for delays, losses, returned packages, or additional costs resulting from an incorrect or incomplete address provided by the customer, although we may assist where reasonably possible.

If we are unable to ship an order within an applicable stated shipping timeframe, or within the period required by applicable law where no timeframe is stated, we will provide any required notice and offer any required cancellation or refund rights.

9. Returns, Refunds, and Exchanges

Purchases made through the Website are subject to our separate Return & Refund Policy, which is incorporated into these Terms by reference.

Eligible products may generally be returned within 30 days after delivery, subject to the conditions and exclusions stated in our Return & Refund Policy.

Certain products, including the following, are final sale and are not eligible for return except where defective, damaged upon arrival, incorrectly shipped, or otherwise required by law:

• Clearance items or items marked Final Sale.
• Tights.
• Socks.
• Undergarments and other hygiene-sensitive items.

We do not offer direct exchanges. Customers seeking a different product, size, or color should return an eligible item in accordance with the Return & Refund Policy and place a new order.

Original shipping charges are non-refundable unless the return results from our error, a defective product, a product materially damaged upon arrival, or another circumstance where a refund of shipping charges is required by law.

10. Intellectual Property

The Website and its contents, including the Body Wrappers name, logos, trademarks, product names, product descriptions, photographs, graphics, designs, text, videos, page layouts, software, and other materials, are owned by or licensed to Body Wrappers and are protected by applicable intellectual property laws.

You may view and use the Website for personal or legitimate purchasing purposes. You may also share links to publicly available product pages for personal, noncommercial purposes.

You may not, without our prior written permission:

• Copy, reproduce, republish, distribute, sell, license, or commercially exploit Website content.
• Use our product photographs, logos, descriptions, or branding for commercial purposes.
• Scrape, crawl, harvest, index, or extract Website data using automated means.
• Use bots or automated tools to purchase products or interfere with Website operation.
• Circumvent Website security features.
• Misrepresent an affiliation with Body Wrappers.
• Use our trademarks or content in a misleading, infringing, or unauthorized manner.

11. Prohibited Conduct

You agree not to:

• Use the Website for fraudulent, unlawful, abusive, or misleading purposes.
• Submit false account, billing, shipping, or payment information.
• Attempt unauthorized access to accounts, payment systems, Website infrastructure, or data.
• Upload or transmit malware, harmful code, or disruptive materials.
• Interfere with Website functionality, security, checkout, or customer experience.
• Abuse promotions, discount codes, store credits, returns, refunds, or chargebacks.
• Infringe the intellectual property, privacy, or other rights of Body Wrappers or any third party.

12. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Website and products are provided on an “as is” and “as available” basis, except for any express warranties provided by us or rights that cannot legally be excluded.

We do not warrant that:

• The Website will always be uninterrupted, error-free, or secure.
• Product photographs or screen displays will exactly represent product color or appearance.
• Size guidance will guarantee a particular fit.
• The Website will be free of viruses or harmful components.

Nothing in these Terms excludes or limits warranties, rights, or remedies that cannot be excluded under applicable consumer protection law.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Body Wrappers and its owners, officers, employees, affiliates, agents, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to the Website, products, orders, or these Terms.

To the fullest extent permitted by applicable law, Body Wrappers’ total liability arising from a particular order or transaction will not exceed the amount you paid to Body Wrappers for the product or order giving rise to the claim.

These limitations do not apply to liability that cannot be limited or excluded under applicable law, including liability arising from fraud, intentional misconduct, gross negligence where applicable, personal injury caused by legally actionable conduct, or mandatory consumer protection rights.

14. Governing Law

These Terms and any dispute arising from or relating to the Website, products, purchases, or these Terms will be governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except to the extent applicable consumer protection law provides you with non-waivable rights under the laws of another jurisdiction.

Body Wrappers reserves the right to pursue claims relating to fraud, unauthorized transactions, intellectual property infringement, or misuse of the Website in any court of competent jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. The updated version will become effective when posted on the Website and will be identified by a revised “Last Updated” date.

Changes will apply prospectively and will not materially alter completed purchases except where permitted by law.

16. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect to the fullest extent permitted by law.

17. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and any applicable promotional or product-specific terms, constitute the entire agreement between you and Body Wrappers concerning the Website and your purchases.
